GENERAL CONDITIONS OF SALE

 

  1. Background and Scope of Application

These Terms and Conditions govern how products are purchased and services are booked through the website www.sangiorgioalapi.it, operated by the Società Agricola F.lli Simoni s.s., based in Strada di Colle Pinzuto No. 30, 53100 Siena (SI), tax code and VAT number 01340150521 (hereinafter "the Company").

These conditions apply to all users, whether they are acting as consumers pursuant to Article 3 of Legislative Decree 206/2005 (Consumer Code), whether they qualify as professionals. Some consumer protections in the regulations do not apply to purchases made by professionals.

The placing of an order or reservation implies full acceptance of these general conditions. If the customer is acting in the capacity of a professional, he expressly declares that the purchase is made within the scope of his economic activity and assumes responsibility for the truthfulness of the information provided.

  1. Subject of the Contract

Through the site, it is possible to purchase agricultural goods (wines and oil) and book farm experiences, such as tastings, tours, events and other activities organized by the Society.

The description of goods and services is written with the utmost accuracy. Any images are for illustrative purposes and may not be perfectly representative of the product being delivered due to packaging, vintage or format reasons.

  1. Prices and Payment Methods

Prices shown on the site are in euros and include VAT, unless otherwise stated. Shipping costs are calculated at the time of order, based on destination and total weight.

Payment is made by secure electronic means (credit cards, PayPal, any other methods indicated) and must be made at the time of order confirmation. In the absence of payment, the transaction will not be completed.

  1. Shipping and Delivery

Shipping is made to the address indicated by the customer, through selected couriers. The approximate delivery time can be consulted in the order process and starts from the confirmation of payment.

The customer is required to check, upon delivery, the integrity of the packaging and the presence of any visible damage. In the presence of anomalies, it is necessary to immediately report to the courier and note reserve on the delivery note. In the absence of reservations, the product is considered delivered in a compliant manner.

  1. Right of Withdrawal and Return

For consumer customers:

Pursuant to Articles 52 et seq. of the Consumer Code, the consumer has the right to withdraw from the contract within 14 (fourteen) days of receipt of the goods, without the obligation to state reasons.

The right of withdrawal does not apply To contracts having as their object:

  • assets that are likely to deteriorate or expire quickly;
  • Sealed goods that are not suitable to be returned for hygienic reasons and have been opened after delivery;
  • Tailor-made or customized goods.

A customer who wishes to make use of the withdrawal must send written notice to the address sangiorgioalapi@gmail.com, indicating order number, goods to be returned and choice between refund or voucher.

Goods must be returned (shipped) at the customer's expense within 14 days of notice of withdrawal, undamaged and in original packaging. Upon receipt of the goods, the Company will refund within 14 days, using the same means of payment or, upon request, by voucher.

For professional clients:

The right of withdrawal does not apply to purchases made by individuals acting for purposes related to their professional activity. The possibility of requesting a return will be evaluated at the discretion of the Company, on a case-by-case basis, depending on the condition of the product and the reason given.

  1. Experience Reservations - Cancellation and Refunds

Booked experiences (tours, tastings, events, etc.) are confirmed only upon full payment. The customer may request cancellation of the reservation, according to the terms below.

  • If the cancellation takes place with at least 72 hours' notice, the customer can choose whether to receive the full refund with the same means of payment or a voucher Of equal value valid for 12 months.
  • If the cancellation takes place between 72 and 24 hours prior, there is no cash repayment, only the issuance of a voucher With a validity of 6 months.
  • The cancellations made More than 24 hours prior to the event, or failure to show up for the booked experience, will result in the integral loss Of the amount paid. There are no refunds or vouchers.

In the event that the Company, for organizational reasons or force majeure, has to cancel the experience, the client will be informed promptly. At his or her option, he or she may receive a refund or reschedule the activity.

  1. Responsibility

The Company is not liable for indirect damages, loss of profit, loss of earnings, or inefficiency caused by delays or problems in the delivery or organization of activities.

The customer is responsible for the proper storage and use of the purchased products.

Clients participating in on-site experiences agree to comply with staff directions and to report any allergies or personal limitations in advance.

  1. Processing of Personal Data

The personal data provided by the customer will be processed in accordance with current legislation (EU Reg. 2016/679 - GDPR) for purposes related to order fulfillment, managing reservations and sending any promotional communications. For more details, please refer to the Privacy Policy available on the website.

  1. Applicable Law and Jurisdiction

These conditions are governed by Italian law.

For clients consumers, any dispute shall be submitted to the jurisdiction of the court of residence or domicile of the consumer, pursuant to the Consumer Code.

For clients professionals, the Court of Siena shall have exclusive jurisdiction, unless otherwise agreed by the parties.
